Buoyed by the provisions of the Nigerian Communications Act 2003 (the Act), the Nigerian Communications Commission, NCC, has called for input into the draft on annual operating levy and frequency spectrum (fees and pricing, among others).

The Act empowers the NCC to periodically review sundry issues relating to its primary duty of regulation with a view to sustaining a culture of standard, cost-effectiveness, consumer protection, investor protection and allied matters that conduce for the promotion of a robust digital economy.

Section 57 (1) of the Act states that “the Commission may hold a public inquiry on any matter of a general nature that relates to the administration of this Act or its subsidiary legislation which will serve the objects of this Act.”

In a public notice published on June 22, 2021, the NCC in exercise of its functions under the Act said public inquiries in respect of the annual operating levy and frequency spectrum fees among others have been scheduled to hold virtually at 11.00am on Tuesday, July 20, 2021.

The two Regulatory Instruments listed for the public inquiry are: Annual Operating Levy Regulations and Frequency Spectrum (Fees and Pricing, etc) Regulations.

“Interested stakeholders are by this notice invited to make written submissions on the subject and participate in the Public Inquiries. Details of the virtual meeting will be forwarded to interested attendees prior to the Public Inquiries,” the notice issued by the Director, Public Affairs of the commission, Dr. Ikechukwu Adinde said.

According to the notice, “all submissions must reach the Commission on or before Monday, July 12, 2021.”
